Terms and Conditions

This website (“helpagoth”, the “Site”) is operated by Akshat Singh Rathore (“we”, “us”, the “Operator”), an individual based in Bangalore, India.

The way to reach us about anything on this Site — a payment, a listing, a complaint, or a data request — is by message on X at @artial_martist.

helpagoth is not a registered charity, trust, society, or non-profit organisation.

A payment through this Site buys you a paid promotional listing: your chosen display name, and any links, photograph and message you supply, shown on the public leaderboard, with your position determined by the total amount you have paid, converted to a USD-equivalent figure.

A sponsorship is the other thing you can buy here: a brand tile in the sponsors rail, in whole multiples of 5 of your chosen currency. Sponsorship payments go toward the cost of running the Site — hosting, payment processing and the domain. A sponsorship is separate from the leaderboard: it earns no rank, and it does not affect anyone else’s position.

Both are commercial transactions for a listing. Neither is a donation, gift, or charitable contribution, neither is tax-deductible, and no receipt for tax-exempt donation purposes will be issued. Nothing on this Site should be read as a promise that your money will be applied to any particular person, cause, purchase, or purpose.

You must be at least 18 years old and legally able to enter into a contract to use this Site or make a payment. By paying, you confirm that you are.

You must also ensure that using this Site and making this payment is lawful where you live. We may refuse, cancel, or remove any listing at our discretion.

Payments are processed by Dodo Payments, a third-party payment provider. We never receive or store your card details. Your payment is also subject to that provider’s own terms and privacy policy.

You may pay in any currency the Site offers. For ranking purposes every payment is converted to a USD-equivalent amount using the exchange rate recorded by the Site at the time your payment is confirmed. That recorded rate is final for ranking, may differ from any rate quoted elsewhere, and is not a currency-conversion service. Your bank or card issuer may apply its own conversion and fees.

Leaderboard positions are relative and change as other people pay. We do not guarantee that any position will be attained, maintained, or displayed for any period of time. Rules affecting ranking, including the premium required to take the top position, may change at any time.

All payments are final and non-refundable, including if you change your mind, if your leaderboard position falls, if you dislike your placement, or if you later ask for your listing to be removed.

This does not affect any right to a refund that you have under applicable law and that cannot lawfully be excluded. If a payment was taken in error or duplicated because of a technical fault, contact us and we will investigate and refund where appropriate.

If you initiate a chargeback instead of contacting us, we may remove your listing and refuse future payments from you.

If you choose Public display, the display name, links, photograph and message you provide are shown publicly on the Internet and may be indexed by search engines, copied, screenshotted, or shared by others, including in ways we cannot control or undo.

If you choose Anonymous display, we do not publish your name, links, or photograph; only the amount contributes to public totals. We still hold the underlying records internally.

You can ask us to remove or amend your listing at any time by contacting us. Removal does not entitle you to a refund, and we cannot retrieve copies that others have already made.

By submitting a display name, link, message, or photograph, you confirm that:

• you own it or have permission to use it, and it is of you or you are entitled to submit it;
• it does not infringe anyone’s rights or breach any law;
• it is not obscene, sexually explicit, hateful, harassing, defamatory, deceptive, or an impersonation of another person or brand; and
• it does not depict, identify, or promote anyone under 18.

You grant us a non-exclusive, worldwide, royalty-free licence to host, display, resize, and reproduce that content for the purpose of operating and promoting the Site, including in share cards and social media posts, for as long as your listing is displayed. You keep ownership of your content.

We may remove any content, at any time, without notice and without refund, if we believe it breaches these terms or exposes us to risk.

If a listing infringes your rights or breaches these terms, message us on X at @artial_martist with enough detail to identify it. We will review reports and act where we consider it appropriate.

We collect and use only what the Site needs to work:

• Email address — collected by the payment provider during checkout and used to identify your payments and contact you about them.
• Listing details — display name, links, photograph, message, and payment amount, published only as described in section 6.
• Country — the two-letter country code our content network derives from your connection, and, for a payment, the billing country reported by the payment provider. We use these only for aggregate statistics. We do not store your IP address.
• Aggregate usage — counts of page views and visitors.

Cookies. The Site sets a cookie recording your cookie choice, so we can honour it and stop asking. If, and only if, you select “Accept”, we additionally set one randomly-generated identifier cookie that lets us tell a returning visitor from a new one. It contains no personal information, is not shared with anyone, and is not used for advertising. If you decline, that cookie is never created and any existing one is deleted; your visit is still counted in our anonymous totals. There are no third-party advertising or tracking cookies on this Site.

Your payment card details are handled by the payment provider and never reach us. We do not sell your personal data, and we do not attempt to identify anonymous visitors or obtain contact details you have not given us.

Where the Digital Personal Data Protection Act, 2023 applies to you, you may request access to, correction of, or erasure of your personal data, you may withdraw consent to public display at any time, and you may change your cookie choice at any time, by messaging us on X at @artial_martist. Withdrawing consent to display does not reverse a payment. We may retain records of transactions for as long as required for legal, accounting, and dispute-resolution purposes.

The Site is provided on an “as is” and “as available” basis. We do not guarantee that it will be uninterrupted, error-free, or available at any particular time, and we may change, suspend, or discontinue it, or any listing, at any time.

To the fullest extent permitted by law, our total liability to you arising out of or in connection with the Site or any payment is limited to the amount you actually paid to us in the twelve months before the event giving rise to the claim.

We are not liable for indirect or consequential loss, or for loss of profit, goodwill, reputation, or opportunity.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including for death or personal injury caused by negligence, or for fraud.

You agree to indemnify us against any claim, loss, or expense arising from content you submit, or from your breach of these terms or of any law.

We may update these terms. The version in force when you paid is the version that governs that payment, and the version you accepted is recorded with your payment. Continuing to use the Site after a change means you accept the updated terms for future payments.

These terms are governed by the laws of India, and the courts at Bangalore, India shall have exclusive jurisdiction, without affecting any mandatory consumer-protection rights you have in your own country of residence.
